EDUCATION OR , THE STATE SUPERINTENDENT OF SCHOOLS, OR, IN
THE CASE OF HIGHER EDUCATION, TO THE MEMBER'S APPOINTING
AUTHORITY, EMPLOYMENT WILL BE AUTHORIZED FOR 1 YEAR.
FURTHER CONTINUATION OF EMPLOYMENT SHALL BE BASED ON THE
EXECUTION OF THE APPROPRIATE APPLICATION FORM NOT LESS THAN
30 NOR MORE THAN 90 DAYS PRIOR TO THE COMPLETION OF EACH
AUTHORIZED YEAR.

(III) IF THE WRITTEN APPLICATION BY THE
MEMBER IS NOT APPROVED, UPON REQUEST, THE MEMBER SHALL BE
GIVEN A FULL HEARING BEFORE THE MARYLAND EMPLOYEES
RETIREMENT REVIEW BOARD PURSUANT TO SECTION 11(2) OF THIS
ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July June 1, 1980.

(House Bill 747)

AN ACT concerning

Nursing Homes - Patient's Bill of Rights

FOR the purpose of establishing the right of a patient or
resident personally or through other persons or in
combination with others to take civil action to redress

certain grievances and seek certain changes; and

providing that certain persons may maintain a cause of
action in law or equity without the prior exhaustion of

administrative remedies for any type of relief

permitted by law providing that nursing home patients,
residents, and certain other persons may file a
complaint alleging a violation of certain provisions
pertaining to the rights of patients in nursing homes;
and providing for the investigation of these
complaints, and a report to be made pertaining to the
complaints, and granting the complainant the right to a
hearing.

BY repealing and reenacting, with amendments,

Section 565C(a)(15) (h)

Annotated Code of Maryland

(1971 Replacement Volume and 1979 Supplement)
