(L) THIS SECTION MAY NOT PREVENT THE SECRETARY FROM
EXERCISING ANY OF HIS POWERS CONFERRED BY ARTICLE 43 OF THE
CODE
(M) THE DIRECTOR MAY REQUEST THAT THE SECRETARY FILE A
PETITION FOR APPOINTMENT OF A RECEIVER WITH RESPECT TO A
NURSING HOME. IF THE SECRETARY, AFTER INDEPENDENT
INVESTIGATION, REASONABLY BELIEVES THAT GROUNDS EXIST FOR
THE APPOINTMENT OF A RECEIVER, THEN THE SECRETARY MAY
PETITION FOR A RECEIVER IN ACCORDANCE WITH THIS SECTION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

AN ACT concerning
Nursing Homes - Resident Abuse
FOR the purpose of providing for a method means of reporting
suspected incidents of abuse of patient residents of
nursing homes; providing for investigation by law
enforcement agencies of incidents of abuse; defining
certain terms; providing for certain written reports to
be prepared by law enforcement agencies; providing
immunity from civil liability for certain persons
making good faith reports; requiring the Department of
Health and Mental Hygiene to supply a sign signs to
each nursing home specifying the reporting requirements
of this Act and requiring each facility nursing home to
post the sign signs in certain locations; providing for
criminal penalties; and generally relating to the
procedure for reporting abuse of certain resident
patients of nursing homes.
