984                                     LAWS OF MARYLAND                                 Ch. 309

YEAR PERIOD. THE DISTRIBUTION SHALL BE MADE FROM CURRENT
COLLECTIONS OF TAXES AND SHALL BE PAYABLE TO THE COUNTIES,
BALTIMORE CITY, INCORPORATED MUNICIPALITIES, AND SPECIAL
TAXING DISTRICTS IN AN AMOUNT EQUAL TO THEIR PRO RATA SHARE
OF THE TAXES WITHHELD BY EMPLOYERS OR PAID AS DECLARATIONS
OF ESTIMATED TAX.

(C)  THE PRO RATA SHARE OF EACH COUNTY AND BALTIMORE
CITY SHALL BE COMPUTED BY MULTIPLYING THE AMOUNT OF TAXES,
WITHHELD BY THE EMPLOYER OR PAID AS DECLARATIONS OF
ESTIMATED TAX, TIMES THE RATIO OF THE SUBDIVISION'S LOCAL
INCOME TAXES COLLECTED FOR THAT YEAR TO TOTAL STATE AND
LOCAL INDIVIDUAL INCOME TAXES COLLECTED FOR THAT YEAR AS
PUBLISHED BY THE COMPTROLLER. THE AMOUNTS TO BE PAID TO THE
COUNTIES AND BALTIMORE CITY SHALL BE REDUCED BY AN AMOUNT
DISTRIBUTED TO INCORPORATED MUNICIPALITIES AND SPECIAL
TAXING DISTRICTS.

(D)  THE PRO RATA SHARE OF INCORPORATED MUNICIPALITIES
AND SPECIAL TAXING DISTRICTS SHALL BE AN AMOUNT EQUAL TO THE
COUNTY'S PRO RATA SHARE FOR EACH YEAR, MULTIPLIED BY THE
QUOTIENT OF THE AMOUNT DISTRIBUTED TO THAT INCORPORATED
MUNICIPALITY OR SPECIAL TAXING DISTRICT FOR THAT YEAR
PURSUANT TO SECTION 323 OF THIS ARTICLE AND THE COUNTY'S
LOCAL INCOME TAX COLLECTION AS PUBLISHED BY THE COMPTROLLER.

(E)  IF, UPON FINAL DETERMINATION, AN ADJUSTMENT
SUBSEQUENT TO THE DISTRIBUTION OF TAXES WITHHELD BY
EMPLOYERS OR PAID AS DECLARATIONS OF ESTIMATED TAX PURSUANT
TO THE PROVISIONS OF THIS SECTION IS MADE FOR A TAX CLAIM,
THE COMPTROLLER SHALL ADJUST THE NEXT DISTRIBUTION OF FUNDS
TO REFLECT THE PROPER PRO RATA SHARE ALLOCATION IN
ACCORDANCE WITH THE TAX CLAIM DETERMINATION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is
hereby declared to be an emergency measure and necessary for
the immediate preservation of public health and safety
and having been passed by a yea and nay vote supported by
three fifths of all the members elected to each of the two
Houses of the General Assembly, the same shall take effect
from the date of its passage shall take effect July 1, 1979.
