SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

AN ACT concerning

CHAPTER 229
(Senate Bill 204)

Criminal Sentences

FOR the purpose of altering the period of imprisonment which
is specified by the Code as the criteria to determine
whether a defendant may demand a jury trial; and
providing a rule to calculate the number of days in a
3-month term of imprisonment.

BY adding to

Article 1 - Rules of Interpretation

Section 2A

Annotated Code of Maryland

(1976 Replacement Volume and 1978 Supplement)

BY repealing and reenacting, with amendments,

Article - Courts and Judicial Proceedings

Section 4-302(d)

Annotated Code of Maryland

(1974 Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 1 - Rules of Interpretation

2A.

IF THE PENALTY SPECIFIED BY THE CODE FOR A CRIME IS
3-MONTHS' IMPRISONMENT, THE PERIOD OF 3 MONTHS SHALL BE
CONSTRUED AND CALCULATED TO BE A PERIOD OF 90-CALENDAR
DAYS.
