(Senate Bill 3)

AN ACT concerning

Election Code - Election Day Expenditures

FOR the purpose of prohibiting any person, candidate, slate
of candidates, political committee, or party and
certain persons from receiving or directly or
indirectly incurring any obligation to pay or receive
any sum of money or thing of value for a political
endorsement or certain acts performed on election day
on behalf of any candidate, slate of candidates, party,
or measure; prohibiting, particularly, the payment or
receipt of any sum of money for walk-around services;
providing a definition for the term "walk-around
services"; and providing certain exclusions.

Section 26-9.1

Annotated Code of Maryland

(1976 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 33 - Election Code

26-9.1.

(A) NO A PERSONS, CANDIDATE, SLATE OF CANDIDATES, OR
POLITICAL COMMITTEE, OR POLITICAL PARTY, OR ANY PERSON
ACTING ON BEHALF OF ANY OF THE FOREGOING, MAY NOT AT ANY

TIME RECEIVE, OR INCUR ANY OBLIGATION, EXPRESSED OR IMPLIED,
TO PAY OR RECEIVE, DIRECTLY OR INDIRECTLY PAY, OR INCUR ANY
OBLIGATION TO PAY, NOR MAY ANY PERSON RECEIVE, DIRECTLY OR
INDIRECTLY ANY SUM OF MONEY OR THING OF VALUE IN RETURN FOR
A POLITICAL ENDORSEMENT OR OR THING OF VALUE FOR SERVICES
TO BE PERFORMED ON THE DAY OF ANY ELECTION ON BEHALF OF ANY
CANDIDATE, PARTY, OR MEASURE, TO BE VOTED UPON AT THE
ELECTION; OR FOR ANY POLITICAL SERVICE PERFORMED ON THIS
DAY, OR FOR ANY LOSS OF TIME OR DAMAGE SUFFERED BY
ATTENDANCE AT THE POLLS AT THE ELECTION. THIS SECTION SHALL
NOT APPLY TO NEWSPAPER, RADIO, TELEVISION, BILLBOARD, OR
AERIAL ADVERTISING, OR TO AMPLIFYING EQUIPMENT, REGULARLY
EMPLOYED CAMPAIGN HEADQUARTERS' PERSONNEL, OR RENTAL OF
CAMPAIGN HEADQUARTERS' FACILITIES, OR TO ANY COST INCURRED
FOR THE PURPOSE OF PROVIDING TRANSPORTATION FOR VOTERS TO
AND FROM POLLING PLACES. WALK-AROUND SERVICES OR ANY OTHER
SERVICES AS A POLL WORKER OR DISTRIBUTOR OF SAMPLE BALLOTS,
PERFORMED BEFORE THE ELECTION POLLS CLOSE ON THE DAY OF THE
ELECTION.
