person so succeeded in possession by such heir,
representative, receiver or trustee in bankruptcy for such
period as may be required for the administration of the
licensee's estate. If two or more persons constitute a
single vendor as defined by § 324(b) of this subtitle, such
persons may operate a single retail establishment under one
license and in such case neither the retirement of one or
more of such persons from business in such establishment nor
the entrance of one or more persons thereinto shall [effect]
AFFECT the license or require the issuance of a new license.
The license required by this section shall be in addition to
all other licenses required to be taken out by any person
under the laws of this State.

In addition to the powers granted to the Comptroller in
this subtitle, he is hereby authorized and empowered:
(g) To employ and fix the compensation of such
assistants, deputies, auditors, investigators, clerks,
stenographers and other employees as he deems necessary for
the administration and enforcement of this subtitle[. For
the purposes of this subsection, the terms, conditions and
limitations contained in Article 64A, known as the merit
system, shall be inapplicable and of no force and effect
until July 1, 1948; provided, however, that persons employed
as provided in this subsection who shall be thus employed on
July 1, 1948, and who shall have been so employed for at
least six months prior thereto shall be considered a part of
and shall hold their positions in accordance with Article
64A, known as the merit system] IN ACCORDANCE WITH THE
PROVISIONS OF THE STATE MERIT SYSTEM LAW.

As used in this subtitle, the following terms shall
mean or include:
(d) "Use" means the exercise by any person within
this State of any right or power over tangible personal
property purchased either within or without this State [of
any right or power over tangible personal property purchased
either within or without this State] and includes but is not
limited to the receipt, storage, keeping or retention for
any length of time of any building materials by any
contractor, builder, or property owner. This term shall
also include but not be limited to use of facilities, tools,
tooling, machinery or equipment (including, but not limited
to dies, molds and patterns) by a purchaser thereof even
though he transfers title to another either before or after
use by him and without regard to whether title is
transferred to the other within or without this State.
This term shall not include the following:
(1) The sale of tangible personal property by
any vendor in the regular course of business.
