Annotated Code of Maryland

(1976 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 33 - Election Code

5-2.

(a) The primary elections by the political parties for
candidates for State offices and central committee shall be
held throughout this State on the second Tuesday after the
first Monday in September. The primary elections by the
political parties in each year in which a national
convention is held for the nomination of candidates for
President and Vice-President shall be held throughout this
State on the [third] SECOND Tuesday in May. A special
primary election to fill a vacancy in the office of
Representative in Congress shall be held on such date as the
Governor shall specify pursuant to § 22-1 (b) of this
article.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

(Senate Bill 716)

AN ACT concerning

Primary Elections - Presidential Candidates and
National Convention Delegates

FOR the purpose of altering the method of selecting district
delegates and at-large delegates to a party's
presidential nominating convention; requiring that
presidential candidates receive a number of district
delegates based on the percentage of the votes received
in that district in the democratic presidential
primary; requiring the district delegates to vote for
this candidate on the first ballot taken at the
democratic national convention; requiring the Secretary
of State to place the names of candidates in the
presidential primary upon the ballot by a certain date;
requiring the Secretary of State to establish a
procedure for the Democratic presidential primary
whereby votes may be cast as uncommitted to any
