receive prior approval of
the General Assembly in
accordance with Article 41,
Section 2 4 5(c) of the Laws
of Maryland.

Provided that no part of this
General Fund appropriation

shall be paid for the

performance of any abortion
to any outpatient clinic or
outpatient facility that

performs Medicaid funded

abortions for profit, and

provided further that no
part of this General
Fund

any physician or surgeon or

any hospital, clinic or

other medical facility for

or in connection with the

performance—of any abortion,
except upon certification by
a physician or surgeon,
based upon his or her

professional judgment, that

the precedure is necessary,

provided          one of the

following conditions exists:

the pregnancy is likely to
result in the death of the

woman; or

2. Where severe and long

lasting physical health

damage to the woman would

result if the pregnancy
were carried to term; or

3. Where medical procedures
are necessary for a victim
of rape or incest, when
the rape or incest has
been reported promptly to

a law enforcement agency.
