courts agree with the department's interpretation of present
law, I would seriously consider proposing legislation which
would repeal the present law.

For these reasons, I have decided to veto House Bill
292.

House Bill No. 310

AN ACT concerning

Good Samaritan Act — Fire Departments and
Rescue Squads

FOR the purpose of providing that the corporate body making
up any State, county, municipal, or volunteer fire
department or rescue squad is immune to civil penalties
for certain acts and under certain circumstances.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill 310.

This bill establishes circumstances under which fire
departments and rescue squads would be immune from civil
liability for acts or failure to act, not amounting to gross
negligence, in Good Samaritan Act situations.

Senate Bill 1031, which was enacted by the General
Assembly and signed by me on May 14, 1979 accomplishes the
same purpose.

Therefore it is unnecessary for me to sign House Bill
310.
