Senate Bill No. 569

AN ACT concerning

Polling Places — Political Advertising

FOR the purpose of prohibiting the wearing or display of
certain political advertising in polling places; and
clarifying language.

Dear Mr. President:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed Senate Bill 569.

This bill makes it a criminal offense to wear or
display in or near polling places any clothing, badge, pin,
or device which supports or opposes a political candidate or
issue.

The Attorney General has advised me that the
prohibition set forth in the bill is an unconstitutional
violation of the free speech guarantee of the United States
and the State Constitutions. A copy of the Opinion of the
Attorney General is attached and should be considered a part
of this veto message.

For this reason I have decided to veto Senate Bill 569.
