Article 78 — Public Service Commission Law

Section 64D to be under the hew subheading "Liquified

Natural Gas Regulation"
Annotated Code of Maryland
(1975 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 78 — Public Service Commission Law

LIQUIFIED NATURAL GAS REGULATION

64D.

(A)     (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)   "LIQUIFIED NATURAL GAS" MEANS NATURAL GAS
COOLED TO FORM A LIQUID AT APPROXIMATELY ATMOSPHERIC

PRESSURE.

(3)   "LIQUIFIED NATURAL GAS FACILITY" MEANS ANY
FACILITY USED FOR THE PRODUCTION, STORAGE, OR

REGASIFICATION, OR TRANSPORTATION BY PIPELINE OF

LIQUIFIED NATURAL GAS.

(B)   THE COMMISSION SHALL ADOPT REGULATIONS TO ENSURE
TO THE GREATEST EXTENT PRACTICABLE THE OPERATIONAL SAFETY OF
ALL LIQUIFIED NATURAL GAS FACILITIES IN THIS STATE.

(C)   THE COMMISSION PERIODICALLY SHALL INSPECT ALL
LIQUIFIED NATURAL GAS FACILITIES IN THIS STATE TO ENSURE
THEIR COMPLIANCE WITH THE REGULATIONS ADOPTED PURSUANT TO
SUBSECTION (B) OF THIS SECTION. THESE INSPECTIONS SHALL BE
CONDUCTED AT INTERVALS THE COMMISSION DETERMINES NECESSARY.

(D)   THE COMMISSION MAY ENFORCE THESE REGULATIONS BY
ANY OF THE METHODS PROVIDED IN §§ 99, 100, AND 102 OF THIS
ARTICLE.

(E)   IN CARRYING OUT ITS RESPONSIBILITIES UNDER THIS
SECTION, THE COMMISSION EXERCISES THE JURISDICTION OF THIS
STATE TO THE FULLEST EXTENT POSSIBLE UNDER FEDERAL, STATE,
OR OTHER LAW. THE COMMISSION MAY ENTER INTO ANY AGREEMENT
WITH FEDERAL AGENCIES NECESSARY TO CARRY OUT THIS SECTION.

(F)   THIS SECTION DOES NOT MAKE ANY PERSON A PUBLIC
SERVICE COMPANY WHO IS NOT ONE UNDER § 2(O) OF THIS ARTICLE.

(G)   ANY PERSON WHO VIOLATES ANY REGULATION ADOPTED BY
THE COMMISSION PURSUANT TO SUBSECTION (A) OF THIS SECTION IS
GUILTY OF A MISDEMEANOR AND UPON CONVICTION IS SUBJECT TO A
