PUBLIC PURPOSE AND NOT FOR THE PROFIT OF ANY PRIVATE PERSON
OR CORPORATION. IF A MUNICIPAL CORPORATION CEASES TO MEET
THE DEFINITION OF "MUNICIPAL CORPORATION" BECAUSE OF ANY
PUBLIC GENERAL OR PUBLIC LOCAL LAW, ANY OF ITS EMPLOYEES WHO
HAVE BEEN A MEMBER OF THIS PENSION SYSTEM MAY CONTINUE
MEMBERSHIP IN THIS SYSTEM AT THE EMPLOYEE'S ELECTION IF THE
EMPLOYER'S CONTRIBUTION, AS REQUIRED HEREIN, CONTINUES TO BE
MADE UNDER THIS SUBTITLE.

(C) TO PARTICIPATE IN THIS PENSION SYSTEM THE
FOLLOWING ENTITIES SHALL BE CONSIDERED TO BE A MUNICIPAL
CORPORATION:

(I)
POTOMAC RIVER BASIN;

THE INTERSTATE COMMISSION ON

THE

MARYLAND, INC.;
AUTHORITY;
APPALACHIA; AND

(II)  A COOPERATIVE LIBRARY COMMISSION;

(III) THE UPPER POTOMAC RIVER COMMISSION;

(IV)  THE TRI-COUNTY COUNCIL FOR WESTERN

(V)

THE

ALLEGANY

COUNTY

TRANSIT

(VI) THE HEALTH PLANNING COUNCIL OF

(VII) THE ST. MARY'S COUNTY NURSING HOME.

(3) "LEGISLATIVE BODY" MEANS COUNTY COMMISSIONERS,
CITY COUNCIL, TOWN COUNCIL, PRESIDENT AND COMMISSIONERS,
BURGESS AND COMMISSIONERS (OR BY WHATEVER OTHER NAME THE
LEGISLATIVE BODY OF ANY INCORPORATED TOWN, CITY, OR
MUNICIPALITY MAY BE KNOWN), AND THE BOARD OR COMMISSION
HAVING AUTHORITY OR CONTROL OVER ANY OTHER POLITICAL
SUBDIVISION OF THE STATE, INCLUDING THE BOARD OR GOVERNING
BODY OF ANY PUBLIC LIBRARY ASSOCIATION OR ORGANIZATION AND
ANY FIRE DEPARTMENT RECEIVING PART OR ALL OF ITS FUNDS FROM
OR THROUGH ANY COUNTY, INCORPORATED TOWN, OR MUNICIPALITY,
OR SPECIAL TAXING AREA, OR OTHER POLITICAL SUBDIVISION OF
THE STATE.

131. ENTITLED TO MEMBERSHIP IN PENSION SYSTEM FOR
OF STATE.

EMPLOYEES

EXCEPT FOR THE OFFICERS AND EMPLOYEES THAT ARE NOW
ELIGIBLE TO PARTICIPATE IN A RETIREMENT SYSTEM WHOLLY OR
PARTIALLY MAINTAINED AT THE EXPENSE OF A MUNICIPAL
CORPORATION, ANY OFFICER OR EMPLOYEE OF A MUNICIPAL
CORPORATION SHALL BE ENTITLED TO MEMBERSHIP IN THIS PENSION
SYSTEM FOR EMPLOYEES OF THE STATE OF MARYLAND AS PROVIDED BY
THIS SUBTITLE AND SUBSEQUENT AMENDMENTS TO IT. AN OFFICER
OR EMPLOYEE OF ANY MUNICIPAL CORPORATION WHO WAS NOT A
MEMBER OF THE EMPLOYEES' RETIREMENT SYSTEM OF THE STATE OF
MARYLAND ON DECEMBER 31, 1979 MAY NOT BE INCLUDED IN THIS
