(F)   WITH THE MARYLAND TUBERCULOSIS ASSOCIATION
AS THE OPERATOR OF RADIOLOGICAL EQUIPMENT UNDER THE
SUPERVISION OF THE MARYLAND HEALTH DEPARTMENT;

(G)   WITH A MUNICIPAL CORPORATION IN MARYLAND;

(H) WITH AN OUT-OF-STATE SCHOOL AS A TEACHER;

(I) WITH THE MARYLAND STATE POLICE IF HE IS NOT
ELIGIBLE FOR VESTING IN THE MARYLAND STATE POLICE RETIREMENT
SYSTEM;

(J) WITH THE FEDERAL GOVERNMENT; OR

(K) WITH AN OUT-OF-STATE MUNICIPALITY.

116. MARYLAND EMPLOYEES RETIREMENT REVIEW BOARD.

THE MARYLAND EMPLOYEES RETIREMENT REVIEW BOARD SHALL
DETERMINE ALL RETIREMENT CASES BROUGHT BEFORE IT BY A MEMBER
OR THE HEAD OF HIS DEPARTMENT UNDER § 117(1)(B) OF THIS
SUBTITLE. SUBJECT TO THAT SECTION, THE BOARD MAY:

(1)   RETIRE THE EMPLOYEE;

(2)   PERMIT HIM TO CONTINUE IN EMPLOYMENT;

(3)   RECOMMEND THAT HE BE TRANSFERRED TO ANOTHER
POSITION IN THE STATE SERVICE; OR

(4)   RECOMMEND THAT HE BE PLACED ON A PART-TIME
EMPLOYMENT BASIS.

117. BENEFITS.

(1) (A) ANY MEMBER MAY RETIRE ON WRITTEN
APPLICATION TO THE BOARD OF TRUSTEES SETTING FORTH AT WHAT
TIME HE DESIRES TO BE RETIRED, PROVIDED THAT THE MEMBER AT
THE TIME HE SPECIFIES FOR HIS RETIREMENT SHALL HAVE
ATTAINED: (I) 30 YEARS OF CREDITABLE SERVICE, OR (II) THE
AGE AND HAVE THE YEARS OF CREDITABLE SERVICE AS FOLLOWS AND
NOTWITHSTANDING THAT DURING THE PERIOD OF NOTIFICATION HE
MAY HAVE SEPARATED FROM SERVICE:

AGE                                  YEARS OF CREDITABLE SERVICE

62         WITH                                    5

63         WITH                                    4

64        WITH                                    3

65 OR MORE WITH                                    2

(B) (I) EXCEPT AS OTHERWISE PROVIDED, ANY
MEMBER IN SERVICE WHO IS 70 YEARS OLD SHALL BE RETIRED ON
THE FIRST DAY OF THE NEXT CALENDAR MONTH FOLLOWING THE
ATTAINMENT OF AGE 70.
