RECOMMENDATIONS THE COMMISSION HAS RECEIVED, THE COMMISSION
WILL EITHER APPROVE OR DENY THE MODIFICATION DEPENDING ON
WILL COMPLY WITH ALL APPLICABLE AIR POLLUTION LAWS AND
REGULATIONS.
(C) FOR ANY ELECTRIC GENERATING STATION FOR WHICH A
CERTIFICATE---©F---PUBLIC--CONVENIENCE---AND NECESSITY HAS BEEN
ISSUED UNDER § 54A OF THIS ARTICLE, THE APPROVAL OF A
MODIFICATION UNDER THIS SECTION SHALL SUPERSEDE THE
CERTIFICATION TO THE EXTENT OF ANY INCONSISTENCY.
(D) (B) NOTWITHSTANDING THE PROVISIONS OF THIS
SECTION, MODIFICATIONS TO ELECTRIC GENERATING STATIONS
INVOLVING THE SHORT-TERM INABILITY TO OBTAIN THE TYPE OF
FUEL NORMALLY USED BY THE STATION SHALL BE SUBJECT TO
ARTICLE 43, SECTION 698A.

Any party or any person in interest, including the
people's counsel, dissatisfied by a final decision or order
of the Commission whether affirmative or negative in form is
entitled to judicial review {thereof] as provided in this
subtitle. For the purposes of this subtitle, the Secretary
of Natural Resources has standing to seek judicial review of
the Commission's final decision or order made pursuant to
Article 78, § 54A and § 54B relative to the environmental
aspects of power plant siting AND THE SECRETARY OF HEALTH
AND MENTAL HYGIENE HAS STANDING TO SEEK JUDICIAL REVIEW OF
THE COMMISSION'S FINAL DECISION OR ORDER MADE PURSUANT TO
ARTICLE 78, § 54H. Where the registration of any motor
vehicle carrier is suspended or revoked by the Motor Vehicle
Administration on order of the Commission, the order of the
Commission, and not the action of the Motor Vehicle
Administration, shall be subject to review.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

Department of Health and Mental Hygiene —
Program and Budgetary Proposals
FOR the purpose of requiring the Secretary of Health and
Mental Hygiene to submit certain program and budgetary
