Ch. 583

purposes of this section, the Montgomery County General
Hospital, Incorporated, of Sandy Spring, Maryland, shall be
construed to be a corporation of this State, organized and
operated exclusively for charitable and educational
purposes, no part of the net earnings of which inures to the
benefit of any private shareholder or individual.

(B) THE CHANGE IN THE RATE OF THE TAX IMPOSED BY THIS
SECTION THAT HAS EFFECTED BY THE ENACTMENT OF CHAPTERS 1 AND
2 OF THE ACTS OF THE SPECIAL SESSION OF THE GENERAL ASSEMBLY
OF 1975 WAS INTENDED TO AND SHALL BE CONSTRUED AS APPLYING
TO AND AFFECTING PROPERTY PASSING AT THE DEATH OF DECEDENTS
WHO DIED ON OR AFTER JUNE 1, 1975. IN CASES OF DECEDENTS
DYING PRIOR TO JUNE 1, 1975, THE TAX ASSESSED UNDER THE
PROVISIONS OF THIS SECTION SHALL BE AT THE RATE IN EFFECT AT
THE DATE OF THE DEATH OF THE DECEDENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

AN ACT concerning

Deep Creek Lake Review Committee and Recreation

Maintenance and Management Fund

FOR the purpose of establishing, within the Department of
Natural Resources, a Deep Creek Lake Recreation
Maintenance and Management Fund for management and
maintenance of recreational facilities and services;
enabling the Department to charge certain fees; and
requiring a hearing under certain circumstances;
providing for disposition of certain moneys in the
Fund; and creating a certain committee and providing
generally for the membership, operation, and powers of
the committee; providing that certain recreational
development moneys may be accepted by the Department of
Natural Resources and deposited into the Fund;
providing for expenditures from the Fund; and
clarifying language.
