(2) (a) Upon retirement for service a member shall
receive a service retirement allowance which shall be
computed as one forty—fifth of his or her average final
compensation for each of the first twenty—five years of
creditable service, and one ninetieth of his or her average
final compensation for each year after the first twenty—five
years of creditable service. The pension which is payable
to any member who has more than twenty—five years of
creditable service as of July 1, 1965, [shall] MAY not be
less than the sum of pension, additional pension and
supplemental pension he or she would have received upon
service retirement under the provisions of this subtitle in
effect prior to July 1, 1965.
[(b) Effective July 1, 1973, the provisions of
this subsection are applicable to members who retired prior
to July 1, 1973. ]
[(c)] (B) Upon the death of any member who has
retired on a retirement service allowance:
(i) There shall be paid to the surviving
spouse, if any, to continue until remarriage of the
surviving spouse, one half of the deceased member's
retirement allowance; or
{ii) If there is no eligible surviving
spouse, or if an eligible surviving spouse dies or remarries
before the youngest child of the deceased member has
attained the age of 18, then one half of the deceased
member's retirement allowance shall be paid to the child or
children, under that age, divided in such manner as the
board in its discretion determines to continue as a joint
and survivorship pension for the benefit of the child or
children under 18 until every child dies or attains 18.
(C) THE PROVISIONS OF THIS SUBSECTION ARE
APPLICABLE TO MEMBERS WHO RETIRED PRIOR TO JULY 1, 1973
1979.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
