HARRY HUGHES, Governor

1635

Baltimore, and the [said] Commission shall see that proper
equipment is provided for the use of [said] THE chief
medical examiner and assistant medical examiners, or
arranged for the use of the laboratory and other equipment
of the State Department of Health, the health department of
Baltimore City, the State Police Department and the police
department of Baltimore City. It shall be the duty of the
chief medical examiner, or an assistant medical examiner, to
be on call at all times for the performance of tie duties
set forth in this article.

7.

(a) If the cause of a death described in § 6 of this
article is established beyond a reasonable doubt, the
medical examiner shall so report and file in his office
within 30 days after his notification of the death. If,
however, in the opinion of the medical examiner, an autopsy
is necessary, the same shall be performed by the chief
medical examiner, an assistant medical examiner or by any
competent pathologists as may be authorized by the chief
medical examiner, except those cases as provided in
subsection (b). A detailed description of the findings
written during the progress of the autopsy, and the
conclusions drawn from the findings, shall be filed in the
office of the chief medical examiner, or in the office of
the deputy medical examiner in the county where the death
occurred. A copy of the findings and conclusions as to the
autopsies performed in the several counties shall also be
filed in the office of the chief medical examiner.
Provided, however, a deputy medical examiner may call upon
the chief medical examiner or an assistant medical examiner,
or other person authorized and designated by the chief
medical examiner, to make an examination or perform an
autopsy whenever he deems it necessary or desirable, and it
shall be the duty of the chief medical examiner or assistant
medical examiner to perform the examination, except in those
cases as a competent pathologist is so authorized by the
chief medical examiner to perform the autopsy. The
necessary expenses for transportation of a body for autopsy
by the chief or an assistant medical examiner or an
authorized pathologist or examination by a deputy medical
examiner and any reasonable fee payable to the authorized
pathologist as has been approved by the chief medical
examiner for each autopsy the authorized pathologist may
perform, shall be paid by the [Comptroller of the] State [of
Maryland out of the revenues of the Racing Commission under
the provisions of Article 78B of this Code].

[It shall be the duty of the Governor to provide for
these payments in the budget for the fiscal year 1957 and
every year after that, and the expenses may not be paid by
the Comptroller unless provision for it has been made in the
budget.]
