court, although it may appear from the evidence that such
person or persons, his or their aiders and abettors, took
and carried away the property or any portion of the same
enumerated in this section, for his or their present use,
and not with the intent of appropriating or converting the
same. The provisions of Article 52, § 13, shall not apply
to this section.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

AN ACT concerning

Wrongful Death — Beneficiaries

FOR the purpose of removing the requirement that a child of
the deceased person be under a certain age in order to
qualify as a beneficiary in a wrongful death action;

and altering the provisions relating to damages

changing a definition to specify the meaning of a child
who is eligible to make a claim for recovery in an
action of wrongful death.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
