AN ACT concerning

Alcoholic Beverages — Nonresident Dealer Permit

FOR the purpose of specifying to whom nonresident alcoholic
beverage dealer permits may be issued; permitting
certain actions concerning certain goods by the holders
of these permits; clarifying a certain purchasing power
in Montgomery County; and generally relating to
nonresident alcoholic beverage dealers.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 2B — Alcoholic Beverages

4.

(h) [Such a permit shall authorize the holder thereof
to sell, consign, and deliver alcoholic beverages from a
location outside Maryland to persons in Maryland who are
authorized to receive same under this article. Provided,
however, no such permit shall be required to make direct
sales and shipments into this State from a location outside
the continental limits and possessions of the United
States.]

(1) A NONRESIDENT DEALER'S PERMIT, FOR THE
PURPOSE OF SELLING BEER, WINE, OR DISTILLED SPIRITS TO
MARYLAND LICENSEES AUTHORIZED TO RECEIVE THOSE BEVERAGES,
MAY BE ISS0ED ONLY TO:

(I)    A BREWER, DISTILLER, RECTIFIER,
BOTTLER, MANUFACTURER, VINTNER, OR WINERY; OR

(II)   A SALES AGENT OF ONE OF THOSE UNDER
SUBPARAGRAPH (I) OF THIS PARAGRAPH, PROVIDED PROOF OF THAT
AGENCY IS PRESENTED THAT IS SATISFACTORY TO THE COMPTROLLER;
OR
