application. The Department, of Health AND MENTAL HYGIENE
shall not issue a permit for a landfill OR SLUDGE COMPOSTING
FACILITY unless it has complied with all county zoning and
land use requirements of the county in which the proposed

landfill OR SLUDGE COMPOSTING FACILITY is to be located and

has an affirmative statement that the board of county
commissioners or the county council does not oppose the
issue of the permit.

(B) THE PROVISIONS OF THIS SECTION RELATING TO SLUDGE
COMPOSTING
FACILITIES DO NOT APPLY IN ANNE ARUNDEL COUNTY.
THE PROVISIONS OF THIS SECTION RELATING TO SLUDGE COMPOSTING

FACILITIES DO NOT APPLY TO SITES WITH PERMITS PENDING WITH

THE DEPARTMENT BEFORE JUNE 1, 1979.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act is

hereby declared to be an emergency measure and necessary for

the immediate—preservation of the public health and—safety
and having been passed by a yea and nay—vote—supported by
three fifths of all the members elected to each of the two

Houses of the General Assembly, the same shall take effect

from the date of its passage shall take effect June 1, 1979.
