FOR the purpose of requiring the State Department of Health
and Mental Hygiene to hold public hearings before
issuing a permit for the collection, handling, burning,

storage, or transportation of sewage sludge; and making

this Act an emergency measure construction of a sludge

composting facility; correcting a__certain obsolete

agency designation; clarifying language; providing for
procedures for periodic application and issuance of
certain permits; and granting the Department certain
powers and duties; and exempting Anne Arundel County
from the provisions of this Act sites with permits
pending before a certain date.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

394.

(E) (1) A PERMIT TO OPERATE A LANDFILL REFUSE DISPOSAL

SYSTEM__OR__SLUDGE COMPOSTING FACILITY SHALL BE VALID FOR A

PERIOD OF 3 YEARS FROM THE DATE OF ISSUE OR THE EFFECTIVE
DATE OF THIS SUBSECTION UNLESS SUSPENDED OR REVOKED BY THE
DEPARTMENT. THE PERMIT SHALL BE AUTOMATICALLY RENEWED UPON
WRITTEN APPROVAL OF THE DEPARTMENT. IF THE DEPARTMENT DOES
NOT GRANT WRITTEN RENEWAL APPROVAL PRIOR TO THE PERMIT'S

EXPIRATION BECAUSE OF FAILURE TO COMPLY WITH THE CONDITIONS

OF THE PERMIT, THE PERMITTEE SHALL COMPLY WITH ALL

PROVISIONS REQUIRED BY THE DEPARTMENT WITHIN THE PRESCRIBED
TIME PERIOD, OR FILE A NEW APPLICATION.

(2) THE PROVISIONS OF THIS SUBSECTION DO NOT

APPLY IN ANNE ARUNDEL COUNTY.

(b) An individual or corporation for commercial

purposes and a municipality, county, district, or

institution may not engage in collection, handling, burning,
