(q) "Orphaned land reclamation project" or "project"
means a competently designed [work] RECLAMATION project,
which may include backfilling and revegetation, to restore
orphaned lands.
(r) "Overburden" means the strata or material
overlying a bituminous coal deposit in its natural state.
[It includes the material before or after its removal by
open-pit mining.]
(s) "Owner's cash contribution" means the sum that an
owner of property benefited by AN ORPHANED LAND reclamation
project agrees to pay in a lump sum on approval of the
project.
(T) "PERMIT" MEANS A PERMIT TO CONDUCT OPEN-PIT MINING
PURSUANT TO THIS SUBTITLE.
[(t)] (U) "Person" includes [any individual, receiver,
trustee, guardian, executor, firm, private or public
corporation, partnership, or any fiduciary or representative
of any kind, or any other administrator's entity.] THE
FEDERAL GOVERNMENT, THE STATE, ANY COUNTY, MUNICIPAL
CORPORATION, OR OTHER POLITICAL SUBDIVISION OF THE STATE, OR
ANY OF THEIR UNITS, OR ANY INDIVIDUAL, RECEIVER, TRUSTEE,
GUARDIAN, EXECUTOR, ADMINISTRATOR, FIDUCIARY, OR
REPRESENTATIVE OF ANY KIND, OR ANY PARTNERSHIP, FIRM
ASSOCIATION, PUBLIC OR PRIVATE CORPORATION, OR ANY OTHER
ENTITY.
[(u) "Pit" means the place bituminous coal is being
mined by the open-pit mining method.
(v) "Plan" or "reclamation plan" means mining and
reclamation plan.]
[(w)] (V) "Principal owner" means an owner or
beneficial owner of at least 10 percent of a corporation,
firm, partnership, or association.
[(x)] (W) "Project construction cost" means total cost
to construct an orphaned land reclamation project, exclusive
of design, supervision, inspection and maintenance costs.
[(y)] (X) "Prospect" means the removal of soil or rock
material overlying bituminous coal to determine the location
or value of the coal resource of the area, but not to sell,
exchange, or transfer.
[(z) "Report," "progress report," or "reclamation
report" means annual mining and reclamation report.]
[(aa)] (Y) "Revolving account" or "account" means an
account established within the Bituminous Coal Open-Pit
Mining Reclamation Fund from the State contribution to the
Fund for purposes of making loans to owners of orphaned
land.
