AN ACT concerning
Air Quality Control Program — Personnel
FOR the purpose of deleting the requirement that certain
positions designated by the Board of Public Works for
the operation and support of the air quality control
program be unclassified and receive salaries set by the
Board; and specifying that all other program employees
be classified employees.

Preamble
WHEREAS, The Department of Personnel believes that the
establishment of positions and salaries for unclassified
personnel involved in the air quality program can be
accomplished by the budgetary process, together with the
authorities contained in Article 64A, Section 27. In
addition, the Department of Personnel is of the opinion that
Article 43, Section 692 could be a legal hinderance to
providing statewide across the board salary increases to
employees of the air quality program. Now, therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section (s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 43 - Health

Such positions within the Department as may be
designated by the Board of Public Works as technical and
professional positions for the operation and support of the
air quality control program shall be unclassified positions
and shall receive such salaries as shall be set by the Board
of Public Works. The other air quality control program
employees shall be classified employees.]
