of this appropriation is

contingent upon the repeal

of Article 43, Section 42A.

If Section 42A of Article 43

is not repealed, this por-
tion of the appropriation

shall revert to the General

Funds appropriated in this

account may also be used to

pay cost settlements arising

from prior years services

Provided that no part of this

may be paid to any physician

or surgeon or any hospital,
clinic, or other medical
facility for or in connec-

tion with the performance of

any abortion, except in the

case of the performance of
an abortion by a physician

or surgeon:

(a) Where the life of the

mother would be endangered
if the fetus were carried

to term; or

(b) Where medical proce-
dures are necessary for a

victim or rape or incest
