REVISOR'S NOTE: This subsection is new language added
to indicate clearly that the powers and duties
enumerated in this section are not exclusive.

(B)   DETERMINATION OF POLICIES AND ADMINISTRATION OF
ARTICLE.

THE STATE BOARD SHALL:

(1)     DETERMINE THE ELEMENTARY AND SECONDARY
EDUCATIONAL POLICIES OF THIS STATE; AND

(2)   CAUSE TO BE CARRIED OUT THOSE PROVISIONS OF
THIS ARTICLE THAT ARE WITHIN ITS JURISDICTION.

REVISOR'S NOTE: This subsection presently appears as
Art. 77, §6(a).

In subsection (b)(1) of this section, the present
phrase "subject to the provisions of this
article" is deleted as unnecessary.

In subsection (b)(2) of this section, the phrase
"within its jurisdiction" is added to modify
"article" as the present reference to "article"
means present Art. 77. In the context of this
revised section, "article" means the entire
Education Article which, of course, includes more
than Art. 77. This is done throughout this
article.

The only other changes are in style.

(C)   BYLAWS, RULES, AND REGULATIONS.

(1)    THE STATE BOARD SHALL ADOPT BYLAWS, RULES,
AND REGULATIONS FOR THE ADMINISTRATION OF THE PUBLIC
SCHOOLS.

(2)    THESE BYLAWS, RULES, AND REGULATIONS HAVE
THE FORCE OF LAW WHEN ADOPTED AND PUBLISHED.

(3)   THE BYLAWS, RULES, AND REGULATIONS APPLY TO
EACH COUNTY. HOWEVER, THEY DO NOT APPLY TO BALTIMORE CITY
TO THE EXTENT THAT THEY RELATE TO MATTERS WHICH THAT ARE THE
SUBJECT OF OTHER PROVISIONS OF THIS ARTICLE THAT DO NOT
APPLY TO BALTIMORE CITY.
