"local board of library trustees and the library

23-308. THEFT OR MUTILATION OF BOOKS OR OTHER PROPERTY.

(A)       PROHIBITED.

A PERSON MAY NOT UNLAWFULLY TAKE, DETAIN, MUTILATE,
INJURE, OR DISFIGURE ANY BOOK, MAP, PICTURE, ENGRAVING,
MANUSCRIPT, OR OTHER PROPERTY OF ANY LIBRARY.

(B)   PENALTY.

ANY PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT
EXCEEDING $250, IMPRISONMENT NOT EXCEEDING 3 MONTHS, OR
BOTH.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 77, §180.

GENERAL REVISOR'S NOTE:

Article 77, §175(b), which provides retirement system
membership for certain library employees is transferred to
Art. 73B of the Code, the Retirement System Law.

The provisions of Art. 77, §§ 181, 182, and 189A, which
authorize Harford, St. Mary's, and Calvert counties to
borrow money for library purposes, are transferred to Art.
25 of the Code for eventual inclusion in the Local
Government Article.
