A BOARD OF TRUSTEES. HOWEVER, A CHARTER COUNTY MAY:

(1)    ESTABLISH A COUNTY LIBRARY AGENCY AND GRANT
IT SOME OR ALL OF THE POWERS OF A BOARD OF TRUSTEES; OR

(2)   HAVE A BOARD OF LIBRARY TRUSTEES, PROVIDE
FOR THE BOARD'S SELECTION, AND DETERMINE ITS POWERS.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 77, §§
171(a) and (b) , and 172(a)(1).

In subsection (a) of this section, the reference
to a library system "free from political
influence" is derived from the applicable
provisions of Art. 77, §§ 172(a) (4) and
173(a)(4).

Art. 77, §§ 181, 182, and 189A, which authorize
Harford, St. Mary's, and Calvert counties to
borrow money for library purposes are transferred
to Art. 25 of the Code for eventual inclusion in
the Local Government Article.

The second sentence of present Art. 77, §171(a)
about the locations of libraries is deleted as
unnecessary in light of the similar provisions of
§23-305 of this subtitle.

The detailed provisions of Art. 77, §171(b) about
library organization in charter counties are
deleted in favor of the simpler, but no less
accurate provisions of subsection (b) of this
section.

Present Art. 77, §171(f), which provides for the
acquisitions of property for libraries is deleted
in light of the general power of a county to own
property in Art. 25, §11A and Art. 25A, §5(b).

23-302. SPECIAL PROVISIONS FOR BALTIMORE CITY AND
WASHINGTON COUNTY.

(A) BALTIMORE CITY.

(1) THE MAYOR AND CITY COUNCIL OF BALTIMORE SHALL BE
GOVERNED BY THE REQUIREMENTS AND REGULATIONS PERTAINING TO
THE ENOCH PRATT FREE LIBRARY OF BALTIMORE CITY AS PROVIDED
IN CHAPTER 181 OF THE ACTS OF 1882 AND ANY OTHER LAWS
APPLICABLE TO THE OPERATION OF PUBLIC LIBRARIES.

(2) THE POWERS AND DUTIES OF THE BOARD OF TRUSTEES OF
THE ENOCH PRATT FREE LIBRARY ARE AS PROVIDED IN CHAPTER 181

OF THE ACTS OF 1882 AND THE CHARTER AND THE ARTICLES OF

INCORPORATION OF THE ENOCH PRATT FREE LIBRARY AND OTHER LAWS
APPLICABLE TO THE BOARD OF TRUSTEES OF THE ENOCH PRATT FREE
LIBRARY.
