77, §165.

The last sentence of present Art. 77, §165, which
specifies the terns of employment of the
professional staff is deleted as unnecessary in
light of the provisions of Title 2 of this
article.

The only other changes are in style.

23-104. AUTHORITY OF STATE BOARD AND STATE SUPERINTENDENT.

(A)   IN GENERAL.

IN ADDITION TO THE OTHER POWERS GRANTED AND DUTIES
IMPOSED BY THIS ARTICLE, THE STATE BOARD HAS THE POWERS AND
DUTIES SET FORTH IN THIS SECTION.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the introductory
language of Art. 77, §163.

(B)   GENERAL POWERS AND DUTIES.

THE STATE BOARD SHALL EXERCISE GENERAL DIRECTION AND
CONTROL OF LIBRARY DEVELOPMENT IN THIS STATE AND MAY:

(1)   ADOPT RULES AND REGULATIONS NECESSARY TO
ADMINISTER THIS TITLE;

(2)   AFTER CONSIDERING THE RECOMMENDATIONS OF THE
ADVISORY COUNCIL ON LIBRARIES, ESTABLISH LIBRARY POLICIES
AND PROCEDURES FOR THE STATEWIDE SYSTEM OF LIBRARIES;

(3)   CONSIDER THE LIBRARY NEEDS OF THIS STATE AND
RECOMMEND TO THE GOVERNOR AND THE GENERAL ASSEMBLY DESIRABLE
LEGISLATION; AND

(4)   WITH THE APPROVAL OF THE GOVERNOR, ACCEPT,
ADMINISTER, AND SPEND ANY APPROPRIATION, GIFT, OR GRANT FOR
LIBRARY PURPOSES FROM THE FEDERAL GOVERNMENT OR FROM ANY
OTHER PERSON.

REVISOR'S NOTE: This subsection presently appears as
Art. 77, §163(1), (2), (3), and (5).

In item (4) of this subsection, the reference to
"approval of the Governor" is added to conform
with the requirements of Art. 15A, §§ 5 and 6 of
the Code.

The only other changes are in style.

The second paragraph of present Art. 77, §163(5)
is deleted as unnecessary in light of the
provisions of Title 2 of this article.
