EMPLOYMENT IN A SHELTERED WORKSHOP OR THAT HIS BEST
INTERESTS REQUIRES THIS TYPE OF EMPLOYMENT.

(B) LIMITATIONS ON EXPENDITURES.

(1) THE DIVISION OF VOCATIONAL REHABILITATION
MAY SPEND THE FUNDS FOR SHELTERED WORKSHOP EMPLOYMENT
PROVIDED IN THE BUDGET.

(2) HOWEVER THE DIVISION MAY NOT SPEND FUNDS FOR
ANY DISABLED INDIVIDUAL UNLESS HE HAS BEEN EMPLOYED BY A
SHELTERED WORKSHOP FOR AT LEAST 1 YEAR.

REVISOR'S NOTE: This section presently appears as Art.
77, §§ 141C and 141F(a).

The only changes are in style.

Present Art. 77, §141F(b), which requires the
Division of Vocational Rehabilitation to
determine that sheltered training is appropriate
is deleted as redundant of the similar provisions
of present Art. 77, §141C(a), now subsection (a)
of this section.

TITLE 22. EDUCATIONAL SERVICES FOR CORRECTIONAL
INSTITUTIONS AND HOSPITALS.

SUBTITLE 1. CORRECTIONAL INSTITUTIONS.

22-101. EDUCATION COORDINATING COUNCIL.

(A)   COUNCIL ESTABLISHED.

THERE IS AN EDUCATION COORDINATING COUNCIL FOR
CORRECTIONAL INSTITUTIONS UNDER THE JURISDICTION OF THE
DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONAL SERVICES WHICH
IS WITHIN THE STATE DEPARTMENT OF EDUCATION FOR
ADMINISTRATIVE AND BUDGETARY PURPOSES.

(B)       COMPOSITION.

(1)   THE COUNCIL CONSISTS OF FIVE MEMBERS.

(2)   ONE OF THE MEMBERS SHALL BE A RESIDENT OF
THIS STATE APPOINTED BY THE GOVERNOR FOR A TERM OF 4 YEARS
AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(3)    THE FOLLOWING OFFICIALS SHALL SERVE EX
OFFICIO:

(I)   THE STATE SUPERINTENDENT OF SCHOOLS;

(II)   THE COMMISSIONER OF CORRECTION;

(III)    THE EXECUTIVE DIRECTOR OF THE STATE BOARD
FOR COMMUNITY COLLEGES; AND
