LAWS OF MARYLAND

Ch. 22

"DISABLED INDIVIDUAL" MEANS AN INDIVIDUAL WHO:

(1)    HAS A SEVERE PHYSICAL OR MENTAL DISABILITY
THAT SERIOUSLY LIMITS HIS MOBILITY, COMMUNICATION, WORK
TOLERANCE, WORK SKILLS, AND ABILITY TO CARE FOR AND DIRECT
HIMSELF, AND FUNCTION GENERALLY;

(2)    CAN BE EXPECTED TO REQUIRE MULTIPLE
VOCATIONAL REHABILITATION SERVICES OVER AN EXTENDED PERIOD

OF TIME; AND

(3)   WHOSE DISABILITY:

(I) RESULTS FROM AMPUTATION, ARTHRITIS,

BLINDNESS, CANCER, CEREBRAL PALSY, CYSTIC FIBROSIS,

DEAFNESS, HEART DISEASE, HEMIPLEGIA, HEMOPHILIA, RESPIRATORY

OR PULMONARY DYSFUNCTION, MENTAL RETARDATION, MENTAL

ILLNESS, MULTIPLE SCLEROSIS, MUSCULAR DYSTROPHY,

MUSCULOSKELETAL DISORDERS, NEUROLOGICAL DISORDERS--INCLUDING

STROKE AND EPILEPSY, PARAPLEGIA, QUADRAPLEGIA AND OTHER

SPINAL CORD CONDITIONS, SICKLE CELL ANEMIA, OR END STAGE

RENAL DISEASE; OR

(II) IS DETERMINED BY AN EVALUATION OF

REHABILITATION POTENTIAL TO CAUSE COMPARABLE SUBSTANTIAL
FUNCTIONAL LIMITATION.

Art. 77, §14lA(a) and (b).

(C) SHELTERED WORKSHOP.

"SHELTERED WORKSHOP" MEANS A WORK ORIENTED PLACE OR
FACILITY OPERATED ON A NONPROFIT BASIS THAT:

(1) IS OPERATED PRINCIPALLY TO PROVIDE:

(I)    SUITABLE WORK, TRAINING, OR RETRAINING IN
MANUFACTURE OR HANDIWORK TO DISABLED INDIVIDUALS WHO BECAUSE
OF A DISABILITY CANNOT FIND GAINFUL EMPLOYMENT ELSEWHERE; OR

(II) GAINFUL EMPLOYMENT TO SEVERELY DISABLED OR
MENTALLY RETARDED INDIVIDUALS; AND

(2)    EXCEPT FOR ITS STAFF, EMPLOYS ONLY DISABLED
INDIVIDUALS.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from Art. 77,
§141A(d).

The only changes are in style.

Present Art. 77, §141A(c), which defines
"Division" is deleted as unnecessary. The full
name of the Division of Vocational Rehabilitation
