AN ACT concerning

State Officers and State Employees

FOR the purpose of authorizing the Board of Public Works to
grant, from certain sources, a sum to satisfy all or
part of a judgment or settlemont settlement or judgment
rendered by a court against a State officer or State
employee; specifying the terms and conditions upon
which the Board may grant this sum; stating certain
findings of the General Assembly; providing that the
immunities or defenses available to an individual State
officer or employee remain unaffected by the provisions
of this Act; defining terms; providing that the defense
of Sovereign Immunity is not abrogated in certain
cases; providing that the action of the Board is final;
requiring the State Law Department to appear and defend
certain civil actions instituted against a State
officer or employee, subject to certain conditions;
clarifying the defense of certain criminal actions by
the Attorney General; expanding the State Insurance
Trust Fund to include all sums appropriated for the
purpose of paying a grant made by the Board of Public
Works to a State officer or employee; authorizing the
State Treasurer to provide self-insurance for losses
sustained by employees if such losses are certified as
payable by the Board of Public Works; and generally
relating to the defense of certain civil actions
instituted against certain public officers or employees
and the payment of certain judgments or settlements
rendered against certain public officers or public
employees.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill 950.

This Administration bill relates to the defense of
certain civil actions instituted against and the payment of
certain judgments or settlements rendered against certain
public officers and public employees.

Senate Bill 594, which was enacted by the General
Assembly and signed by me on May 29, 1978, is the companion
Administration measure which accomplishes the same purpose.

Therefore it is unnecessary for me to sign House Bill
950.
