VETOES

FOR the purpose of providing that a homeowner who qualifies
for has proof of qualification benefits is eligible for
a tax credit at a certain time.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed House Bill 39.

This bill amends the provision for circuit breaker tax
relief to allow a homeowner to qualify for a credit on proof
of qualification benefits.

House Bill 1168, which was enacted by the General
Assembly and signed by me on May 2, 1978, creates a new
program of property tax credits and includes a similar
provision. In addition, the Attorney General has advised me
that House Bill 89 should not be signed if House Bill 1168
is signed. A copy of the Opinion of the Attorney General is
attached and should be considered a part of this veto
message.

For these reasons, I have decided to veto House Bill

89.
