BE ADVISED WHETHER ANNUAL OR BIENNIAL AUDITS WILL BE
CONDUCTED,

(III) THE COST OF THE FISCAL PART OF THE POST
AUDIT EXAMINATIONS SHALL BE BORNE BY THE UNIVERSITY
HOSPITAL.

REVISOR'S NOTE: This section presently appears as Art.
77A, §15(e)(2), (3), (5), and (6).

The General Assembly may wish to consider whether
the list of schools in subsection (d)(2) of this
section is intended to exclude, for example,
University College and University of Maryland,
Baltimore County, and whether subsection (d)(2)
of this section should be revised to include all
income.

13-106. EMPLOYEES.

(A)   GENERAL POWER.

THE BOARD OF REGENTS SHALL MAKE ALL APPOINTMENTS TO
POSITIONS AT THE UNIVERSITY OF MARYLAND FROM NOMINATIONS
SUBMITTED TO IT BY THE PRESIDENT OF THE UNIVERSITY. THE
BOARD MAY DELEGATE TO THE PRESIDENT THE POWER TO MAKE ANY OF
THESE APPOINTMENTS.

(B)   CONDITIONS OF EMPLOYMENT.

(1)    APPOINTMENTS AT THE UNIVERSITY ARE NOT
SUBJECT TO OR CONTROLLED BY THE PROVISIONS OF THE MERIT
SYSTEM LAW.

(2)    AFTER APPOINTMENT, EMPLOYEES IN POSITIONS

DESIGNATED BY THE UNIVERSITY SHALL BE REGARDED AND TREATED
AS CLASSIFIED EMPLOYEES OF THIS STATE AND:

(I)    HAVE ALL THE RIGHTS AND PRIVILEGES OF

CLASSIFIED EMPLOYEES;

(II)   HAVE THE RIGHT OF APPEAL AS PROVIDED BY LAW
IN ANY CASE OF ALLEGED INJUSTICE;

(III)   SHALL BE PAID SALARIES NOT LESS THAN THOSE
PAID IN SIMILAR CLASSIFICATIONS IN OTHER STATE AGENCIES; AND

(IV)   SHALL RETAIN THEIR VACATION PRIVILEGES,
RETIREMENT STATUS, AND BENEFITS UNDER THE STATE RETIREMENT
SYSTEM.

(3)   THE UNIVERSITY IS SUBJECT TO THE STATE MERIT
SYSTEM LAW WITH RESPECT TO NONACADEMIC EMPLOYEES AT ITS
BRANCHES IN:

(I)   BALTIMORE CITY;

(II)   BALTIMORE COUNTY;
