Section 8-403(c)

Annotated Code of Maryland

(As enacted by Chapter ____ of the Acts

of the General Assembly of 1978)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ____ of the Acts of the General

Assembly of 1978) be repealed, amended, or enacted to read
as follows:

Article — Education

8-403.

(c) The standards for the education of handicapped
children who are enrolled in programs that are operated by
an agency ether than a county board may not be lower than
the standards for the education of children who are enrolled
in programs that are operated by a county board. THE STATE

BOARD MAY NOT ESTABLISH STANDARDS FOR NONPUBLIC EDUCATIONAL

INSTITUTES FOR THE HANDICAPPED THAT ARE DIFFERENT FROM

STANDARDS FOR PUBLIC INSTITUTES FOR THE HANDICAPPED. THE

STANDARDS FOR THE APPROVAL OF PROGRAMS LOCATED IN

JURISDICTIONS OUTSIDE MARYLAND SHALL BE THE SAME AS

STANDARDS APPLICABLE TO THE APPROVAL OF PROGRAMS WITHIN

MARYLAND. HOWEVER, NO PROGRAM LOCATED IN A JURISDICTION
OUTSIDE MARYLAND SHALL BE APPROVED IF THE CHARGES FOR PUPILS
APPROVED BY THE DEPARTMENT ARE HIGHER THAN CHARGES FOR
PUPILS FROM ANY OTHER STATE FOR THE SAME SERVICES, UNLESS
WAIVED BY THE STATE SUPERINTENDENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
