AN ACT concerning
State Treasury - Personal Funds of Patients and Inmates
Residents and Clients
FOR the purpose of permitting the State Treasurer to exclude
personal funds of patients or inmates residents or
clients of certain State—operated facilities from being
deposited in the State Treasury; providing for the
deposit of those funds if so excluded; and generally
relating to the personal funds of patients and inmates
residents and clients of certain State-operated
facilities.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 95 - Treasurer
21B.
THE TREASURER MAY EXCLUDE PERSONAL FUNDS OF PATIENTS OR
INMATES RESIDENTS OR CLIENTS OF STATE-OPERATED INSTITUTIONS,
HOSPITALS, AND CENTERS FROM BEING DEPOSITED IN THE STATE
TREASURY. IN THE EVENT OF AN EXCLUSION THE STATE-OPERATED
INSTITUTIONS, HOSPITALS, AND CENTERS SHALL DEPOSIT PERSONAL
FUNDS OF PATIENTS RESIDENTS OR CLIENTS IN A BANK OR BANKS,
OR IN A TRUST COMPANY OR TRUST COMPANIES, OR IN A BUILDING
AND LOAN ASSOCIATION OR BUILDING AND LOAN ASSOCIATIONS, AS
APPROVED BY THE STATE TREASURER, IN INTEREST-BEARING
ACCOUNTS WITH THE INTEREST BEING CREDITED TO THE ACCOUNT OF
THE PATIENTS OR INMATES RESIDENTS OR CLIENTS. THE TREASURER
MAY REQUIRE THE SUBMISSION OF A WRITTEN AGREEMENT BETWEEN
THE INSTITUTION AND THE DEPOSITORY FOR HIS APPROVAL.
STATE-OPERATED INSTITUTIONS, HOSPITALS, AND CENTERS SHALL
MAINTAIN OR HAVE MAINTAINED ADEQUATE RECORDS TO FULLY
ACCOUNT FOR ALL RECEIPTS, DISBURSEMENTS, AND INTEREST
EARNINGS FOR EACH PATIENT OR INMATE RESIDENT OR CLIENT AND
TO RENDER EACH PATIENT OR INMATE RESIDENT OR CLIENT A
