(a) A minor shall have the same capacity to consent
to medical treatment as an adult if one or more of the

following apply:

(1) The minor is married or the parent of a

child.

(2) The minor seeks treatment or advice

concerning venereal disease, pregnancy or contraception not

amounting to sterilization, OR IS THE VICTIM OF AN ALLEGED

RAPE OR SEXUAL OFFENSE.

minor, the obtaining of consent or the notification of any

other person would result in such delay of treatment as
would adversely affect the life or health of the minor.

(4) The minor seeks treatment or advice

concerning any form of drug abuse as defined in Section 2
(d) of Article 43B of the Annotated Code.

(5) The minor seeks treatment or advice

concerning any form of alcoholism as defined in § 103(c) of
Article 2C of the Annotated Code.

135B.

A MINOR WHO IS THE VICTIM OF AN ALLEGED RAPE OR SEXUAL

OFFENSE HAS THE SAME CAPACITY AS AW ADULT TO CONSENT TO A

PHYSICAL EXAMINATION FOR THE PURPOSE OF ESTABLISHING AND
GATHERING INFORMATION AND EVIDENCE AS TO THE CRIME.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
