Preamble
When an employee transfers from one position to a
higher position in the Executive Branch, regardless of
whether the position is classified or unclassified, that
employee is entitled to receive a promotional increase in
salary of at least 6 percent. The Department of Personnel
has refused to recognize the prior service of certain
General Assembly employees for the purpose of receiving the
promotional increase when transferring to a higher position
in the Executive Branch even though these employees served
with the General Assembly in a full time permanent capacity.
The basis for the Department's ruling is that the Secretary
of Personnel does not have jurisdiction over the salaries of
employees of the State Legislature which means that the
denial of the promotional increase will apply to all General
Assembly employees. All full time permanent State employees
should be able to accept a higher position in any branch of
State government without being required to start at the base
salary, provided the starting salary is agreeable to the
hiring authority and to the employee; now, therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 64A - Merit System
26.
(A) ALL FULL TIME PERMANENT EMPLOYEES OF THE GENERAL
ASSEMBLY OF MARYLAND, THE DEPARTMENT OF LEGISLATIVE
REFERENCE, OR THE DEPARTMENT OF FISCAL SERVICES SHALL BE
CONSIDERED AS FULL TIME PERMANENT STATE EMPLOYEES FOR THE
PURPOSES OF TRANSFERRING TO A POSITION IN THE EXECUTIVE OR
JUDICIAL BRANCH OF GOVERNMENT. THESE EMPLOYEES SHALL
RECEIVE CREDIT FOR SERVICE WITH THE GENERAL ASSEMBLY FOR THE
PURPOSES OF TRANSFERRING ACCUMULATED SICK AND VACATION
LEAVE, SERVICE CREDIT IN THE EMPLOYEES' RETIREMENT SYSTEM,
AND ALL OTHER BENEFITS. FURTHER, THESE EMPLOYEES SHALL BE
GRANTED THE SAME SALARY CONSIDERATION THAT WOULD BE PROVIDED
TO AN EMPLOYEE TRANSFERRING WITHIN THE EXECUTIVE OR JUDICIAL
BRANCH.
(B) ON THE TRANSFER OF A GENERAL ASSEMBLY EMPLOYEE,
AN EMPLOYEE OF THE DEPARTMENT OF LEGISLATIVE REFERENCE, OR
