Ch. 22

(1)    EACH COUNTY FIRST SHALL CONTRIBUTE THE
AMOUNTS PROVIDED FOR IN §8-4 17.3 (D) (1) OF THIS SUBTITLE FOR
EACH OF THESE CHILDREN DOMICILED IN THE COUNTY; AND

(2)   FOR EACH OF THESE CHILDREN, THE STATE SHALL
CONTRIBUTE FOR FISCAL YEARS 1979 THROUGH 1981, AN AMOUNT
EQUAL TO THE FULL AMOUNT REQUIRED UNDER §8-417.3(D)(2) OF
THIS SUBTITLE.

REVISOR'S NOTE: This section presently appears as Art.
77, §106G-4.

Present Art. 77, §106G-4(c) (2) and (3), which
relates to fiscal years 1977 and 1978, is deleted
as obsolete.

Present Art. 77, §106G-4(d) (2) (i) , which relates
to fiscal year 1977, is deleted as obsolete.

The only other changes are in style.

8-417.3. FUNDING FOR SPECIAL EDUCATIONAL SERVICES — FISCAL
YEAR 1981.

(A)   SPECIAL EDUCATIONAL SERVICES FUNDED UNDER THIS
SECTION.

THE SPECIAL EDUCATIONAL SERVICES REQUIRED UNDER §§
8-401 THROUGH 8-409 OF THIS SUBTITLE FOR FISCAL YEAS 1981
SHALL BE FUNDED IN ACCORDANCE WITH THIS SECTION.

(B)   COUNTY TO FUND BASIC COST.

EACH COUNTY SHALL CONTRIBUTE THE BASIC COST FOR EACH
CHILD DOMICILED IN THE COUNTY WHO, DURING THE FISCAL YEAR,
RECEIVES SPECIAL EDUCATIONAL SERVICES, WHETHER IN A PUBLIC
OR NONPUBLIC PROGRAM.

(C)   FUNDING OF EXCESS COST.

THE STATE AND EACH COUNTY SHALL SHARE COLLECTIVELY IN A
CONTRIBUTION OF $100,000,000 AS THE PUBLIC FUNDING OF THE
EXCESS COST IN ACCORDANCE WITH THE FOLLOWING FORMULA:

(1)    FIRST: THE SUM OF $100,000,000 SHALL BE
DIVIDED BY THE AGGREGATE NUMBER OF STUDENTS ENROLLED IN ALL
OF THE COUNTIES AS OF SEPTEMBER 30 OF THE PREVIOUS SCHOOL
YEAR, AND THE QUOTIENT SHALL BE EXPRESSED AS A DOLLAR FIGURE
ROUNDED TO THE THIRD DECIMAL PLACE;

(2)    SECOND: THE NUMBER OF STUDENTS ENROLLED AS
OF SEPTEMBER 30 OF THE PREVIOUS SCHOOL YEAR, IN EACH COUNTY,
SHALL BE MULTIPLIED BY THE QUOTIENT DETERMINED UNDER ITEM
(1) OF THIS SUBSECTION; THE PRODUCT IS THE INITIAL TOTAL
EXCESS COST PROGRAM FOR THE COUNTY;

(3)   THIRD: THE SUM OF $30,000,000 SHALL BE
DIVIDED BY THE AGGREGATE HEALTH OF ALL OF THE COUNTIES, AND
