(2) SALES OF FOOD FOR HUMAN CONSUMPTION FOR
LESS THAN $2 $1; SALES OF FOOD FOR HUMAN CONSUMPTION BY A
VENDOR OPERATING A BUSINESS WHICH PROVIDES NO FACILITIES FOR
CONSUMPTION OF THE FOOD ON THE PREMISES; AND SALES OF FOOD
FOR HUMAN CONSUMPTION OFF OF THE PREMISES BY A VENDOR WHO
HAS FACILITIES FOR CONSUMPTION OF FOOD ON THE PREMISES BUT
WHO, AT THE SAME LOCATION, CONDUCTS A BONA FIDE AND
SUBSTANTIAL GROCERY OR MARKET BUSINESS. THE TERM
"FACILITIES" DOES NOT INCLUDE MERE PARKING SPACES FOR
VEHICLES. THE TERM "PREMISES" INCLUDES ANY BUILDING,
GROUNDS, PARKING LOT OR OTHER AREA, OWNED OR CONTROLLED, IN
WHOLE OR IN PART, BY THE VENDOR, OR WHICH A THIRD PARTY HAS
MADE AVAILABLE PRIMARILY FOR THE USE OF PATRONS OF THE
VENDOR OR A GROUP OF FOOD VENDORS. THE EXEMPTIONS CREATED
BY THIS PARAGRAPH, OTHER THAN THAT FOR SALES OF LESS THAN
$2, DO NOT APPLY TO SALES BY A VENDOR SELLING FOOD WITHIN AN
ENCLOSURE FOR WHICH A CHARGE IS MADE FOR ADMISSION OR TO
SALES BY A VENDOR OR OF FOOD WHICH HE SERVES FOR CONSUMPTION
ON THE PREMISES OF HIS PURCHASER OR OF A THIRD PARTY.
SECTION 2. AND BE IT FURTHER ENACTED, That the passage
of this Act is contingent upon the passage of Senate Bill
No. 832 of 1978. Should that measure fail of enactment, the
provisions of this Act are null and void without the need of
further action by the General Assembly.
SECTION 2 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning
Creation of a State Debt -
Maryland Small Business Development Financing Authority
FOR the purpose of authorizing the creation of a State Debt
in the amount of $5,000,000 $2,000,000, the proceeds to
be used to create a fund for a certain State program
for the purpose of making loans to and guaranteeing
loans made to certain businessmen for certain purposes
and subject to certain conditions; and made part of the
Small Business Development Financing Fund of the
Maryland Small Business Development Financing Authority
established by Section 266 HH-8 of Article 41 of the
Annotated Code of Maryland, and to be subject to all
the terms, conditions, and purposes set forth in
Sections 266 HH-1 through 266 HH-12, inclusive, of the
