(II)   THAT NO MORE THAN 500 CUBIC YARDS OF
MATERIAL BE DREDGED AT EACH MAINTENANCE DREDGING TO RESTORE
LICENSED WORKS;

(III)  THAT THE MATERIAL FROM MAINTENANCE
DREDGING BE DEPOSITED UPON THE DESIGNATED OR OTHER UPLAND
SITE APPROVED BY THE SECRETARY;

(IV)   THAT THE SECRETARY BE NOTIFIED AND
APPROVE OF EACH MAINTENANCE DREDGING OPERATION.

(5)    THE PROVISIONS FOR      PERIODIC MAINTENANCE
DREDGING UNDER THE AFOREMENTIONED     CONDITIONS SHALL BE
EFFECTIVE FOR NO MORE THAN 6 YEARS     BEYOND THE DATE OF
ISSUANCE OF THE LICENSE.

(6)    IF THE LICENSEE DESIRES TO CONTINUE
MAINTENANCE DREDGING BEYOND THE EXPIRATION DATE AUTHORIZED
IN ITEM (5), HE MUSI OBTAIN A NEW LICENSE BY SUBMITTING AN
APPLICATION TO THE BOARD FOR REVIEW IN ACCORDANCE WITH THE
PROCEDURES OF THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Coal Mining — Severance Surcharge

FOR the purpose of adding to the declaration of the policy
of the State in the protection and conservation of the
natural resources of this State; providing for a
redistribution of the amounts collected for the
severance surcharge; providing for certain reports to
be filed with the Secretary of the Department of
Natural Resources; and generally relating to the
collection and distribution of the coal mining
severance surcharge.
