Annotated Code of Maryland

(1976 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

67B.

(A) IN ADDITION TO ANY OTHER PROCEDURES, AN IMPOUNDED
DOMESTICATED ANIMAL MAY NOT BE SOLD, DESTROYED OR OTHERWISE
DISPOSED OF BY AN ANIMAL CONTROL AGENCY UNTIL:

(1)    THE ANIMAL HAS BEEN CAREFULLY INSPECTED FOR
A TAG, TATTOO, OR OTHER IDENTIFICATION TO ASCERTAIN THE

OWNER;

(2)    THE OWNER IS NOTIFIED IF HIS IDENTITY IS
MAY REASONABLY BE ASCERTAINED BY THE INSPECTION;

(3)    72 HOURS AFTER NOTICE HAS BEEN GIVEN TO THE
OWNER HAS BEEN GIVEN.

(B) THE OWNER SHALL PAY ALL FEES, COSTS, AND EXPENSES
REQUIRED INCURRED BY THE ANIMAL CONTROL AGENCY.

(C)    AS USED IN THIS SECTION, "ANIMAL CONTROL AGENCY"
MEANS THE LOCAL ORGANIZATION OR GOVERNMENTAL UNIT OR AGENCY
DESIGNATED BY THE APPROPRIATE LOCAL GOVERNMENTAL BODY TO
HOUSE, CARE FOR, AND CONTROL DOMESTIC ANIMALS OF UNKNOWN
OWNERSHIP.

(D)    ANY PERSON WHO IS CONVICTED OF A VIOLATION OF ANY
OF THE PROVISIONS OF THIS SECTION IS GUILTY OF A MISDEMEANOR
AND IS SUBJECT TO A FINE OF NOT MORE THAN $500.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
