7-410. PRESERVATION OF RIGHTS OF STUDENT SEEKING TO
OVERCOME DRUG ABUSE.

(A)   INADMISSABILITY OF STATEMENT OF STUDENT.

IF A STUDENT SEEKS INFORMATION TO OVERCOME ANY FORM OF
DRUG ABUSE, AS DEFINED IN ARTICLE 43B, §2(D) OF THE CODE,
FROM A TEACHER, COUNSELOR, PRINCIPAL, OR OTHER PROFESSIONAL
EDUCATOR EMPLOYED BY AN EDUCATIONAL INSTITUTION THAT HAS
RECEIVED A CERTIFICATE OF APPROVAL UNDER §2-206 OF THIS
ARTICLE, A STATEMENT, WHETHER ORAL OR WRITTEN, MADE BY THE
STUDENT OR AN OBSERVATION OR CONCLUSION DERIVED FROM THE
STATEMENT IS NOT ADMISSIBLE AGAINST THE STUDENT IN ANY
PROCEEDING.

(B)    RULES AND REGULATIONS MAY NOT REQUIRE DISCLOSURE.

A RULE, REGULATION, OR ORDER MAY NOT REQUIRE DISCLOSURE
OF ANY REPORT, STATEMENT, OBSERVATION, CONCLUSION, OR OTHER
INFORMATION THAT HAS BEEN ASSEMBLED OR OBTAINED BY AN
EDUCATOR THROUGH THIS CONTACT.

In subsection (a) of this section, the present
reference to Art. 77, §12 is deleted as that
section has been repealed.

7-411. ALCOHOL ABUSE PROGRAM.

(A)   STATE BOARD TO IMPLEMENT PROGRAM.

(1)    BY THE FALL OF 1978, THE STATE BOARD SHALL
DEVELOP AND IMPLEMENT A PROGRAM OF HEALTH EDUCATION THAT
DEALS SPECIFICALLY WITH THE ABUSE OF ALCOHOL.

(2)    THIS PROGRAM MAY BE INCLUDED IN THE DRUG
EDUCATION PROGRAM UNDER §7-409 OF THIS SUBTITLE.

(B)   COORDINATION WITH OTHER STATE AGENCIES.

THIS PROGRAM SHALL BE COORDINATED WITH OTHER STATE
AGENCIES THAT ARE RESPONSIBLE FOR ALCOHOL ABUSE EDUCATION
AND CONTROL.
