disabled persons in each county or multicounty region
of the State; providing for definitions; authorizing
the establishment and location of such group homes;
authorizing the State to acquire, under certain
circumstances, facilities and sites for such group
homes; and relating generally to group homes for
nonretarded developmentally disabled persons.

BY adding to

Article 43 - Health

Section 1001 through 1005, inclusive, to be under the

new Subtitle "Nonretarded Developmentally

Disabled Persons"
Annotated Code of Maryland
(1971 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

NONRETARDED DEVELOPMENTALLY DISABLED PERSONS

1001.

(A)    AS USED IN THIS SUBTITLE, THE FOLLOWING TERMS
HAVE THE MEANINGS INDICATED.

(B)    "NONRETARDED DEVELOPMENTALLY DISABLED PERSON"
MEANS A PERSON WHOSE DISABILITY IS:

(1) ATTRIBUTABLE TO CEREBRAL PALSY, EPILEPSY,
AUTISM, DYSLEXIA, OR ANY OTHER NEUROLOGICAL MALFUNCTION OR
DISORDER;

(2) ORIGINATES BEFORE SUCH PERSON ATTAINS AGE

18;

(3) (2) HAS CONTINUED OR CAN BE EXPECTED TO
CONTINUE INDEFINITELY;

(4) (3) CONSTITUTES A SUBSTANTIAL HANDICAP TO
SUCH PERSON'S ABILITY TO FUNCTION NORMALLY IN SOCIETY.

(C)    "GROUP HOME" MEANS A BARRIER FREE,
COMMUNITY-BASED RESIDENTIAL FACILITY WHICH ADMITS AT LEAST
FOUR BUT NO MORE THAN EIGHT NONRETARDED DEVELOPMENTALLY
DISABLED PERSONS WHO, BECAUSE OF THEIR DISABILITY, REQUIRE
SPECIALIZED LIVING ARRANGEMENTS AND PROVIDES A HOME TYPE
ENVIRONMENT UNDER THE CARE, CONTROL, AND SUPERVISION OF TWO

UNDER APPROPRIATE SUPERVISION BY RESIDENTIAL STAFF.

(D)    "DIRECTOR" "SECRETARY" MEANS THE DIRECTOR OF THE

PREVENTIVE MEDICINE ADMINISTRATION SECRETARY OF THE STATE
