(2)  That, if a judgment is rendered against the officer
or employee, the State, its agency, board, commission, or
department thereof, is not responsible for the payment of
the judgment, and the legal representation by the Attorney
General, his assistants, or special counsel of an officer or
employee in no manner constitutes an obligation on the part
of the state to pay the judgment or a settlement of a
claim[,], BUT THAT THE OFFICER OR EMPLOYEE MAY MAKE WRITTEN
APPLICATION TO THE BOARD OF PUBLIC WORKS PURSUANT TO §16C OF
ARTICLE 78A OF THE CODE.

(3)   That the Attorney General shall not compromise or
settle any claim without the written consent of the officer
or employee. If the officer or employee does not consent to
the compromise or settlement, the Attorney General may
withdraw from the representation subject to the appropriate
rules of court; and in that event the state is not
responsible for any further costs whatsoever.

Article 95 — Treasurer
27.

(a) The Treasurer shall provide self—insurance for:

1.     Loss or damage to State motor vehicles;

2.     Loss or damage to hulls of State vessels;

3.     Loss or damage to State personal property
and fine arts;

4.     Loss or damage to State real property not
provided by purchased insurance, [and]

5.     ANY LOSS SUSTAINED BY A STATE OFFICER OR

EMPLOYEE AS THE RESULT OF A JUDGMENT OR SETTLEMENT

SETTLEMENT OR A JUDGMENT RENDERED BY A COURT OF COMPETENT
JURISDICTION AGAINST HIM, IF THE PAYMENT OF SUCH A LOSS IS
CERTIFIED BY THE BOARD OF PUBLIC WORKS UNDER §16C OF ARTICLE
78A OF THE CODE; AND

[5.] 6. Such other loss risks as determined
by the State Treasurer and for which funds are available.

29.

(a)    The fund shall comprise the following moneys:

(b)    All sums appropriated either as general funds or
special funds to the Treasurer or to any other State agency
in the annual State budget to provide for self-insurance;

(C) ALL SUMS APPROPRIATED EITHER AS GENERAL FUNDS OR
SPECIAL FUNDS TO THE STATE INSURANCE TRUST FUND IN ORDER TO
PAY A GRANT TO A STATE OFFICER OR EMPLOYEE UNDER §16C OF
