AN ACT concerning

Medical Records - Privacy

FOR the purpose of permitting certain persons and
organizations to reveal specific medical information
contained in medical records to the person on whoa the
record is maintained and that person's representative
or agent; prohibiting certain persons and organizations
from revealing specific medical information contained
in medical records to any person other than the person
on whom the record is maintained and that person's
representative or agent, with certain exceptions;
providing certain penalties; and generally relating to
the privacy of medical records.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

54L.

(A)    ANY PROVIDER OF MEDICAL CARE HAVING CUSTODY OF
MEDICAL RECORDS MAY REVEAL SPECIFIC MEDICAL INFORMATION
CONTAINED IN THOSE RECORDS TO THE PERSON ON WHOM THE RECORD
IS MAINTAINED, OR HIS AGENT OR REPRESENTATIVE, OR AS
AUTHORIZED IN SUBTITLE 20 OF ARTICLE 48A OF THE CODE.

(B)    ANY PROVIDER OF MEDICAL CARE HAVING CUSTODY OF
MEDICAL RECORDS MAY NOT REVEAL SPECIFIC MEDICAL INFORMATION
CONTAINED IN THOSE RECORDS TO ANY PERSON UNLESS AUTHORIZED
BY THE PERSON ON WHOM THE RECORD IS MAINTAINED.

(C) THIS SECTION DOES NOT APPLY TO PROVIDERS OF
MEDICAL CARE HAVING CUSTODY OF MEDICAL RECORDS:
