AN ACT concerning

CHAPTER 702
(House Bill 1455)

Sanitary Facilities Fund

FOR the purpose of specifying , under certain circumstances,

    that language contained in sanitary facilities sewerage

loan authorized legislation relating to maximization
of the use of federal funds refers only to funds

Act, unless expressly stated otherwise certain federal
funds may not be included in computing total federal
grants for the purpose of determining the maximum
federal grant amount.

BY repealing and reenacting, with amendments,

Article 43 - Health

Section 387B(a)2

Annotated Code of Maryland

(1971 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

387B.

(a) A Sanitary Facilities Fund is hereby established-
It shall consist of two parts, as follows:

2. The construction part which shall be
available to the Board of Public Works to finance
construction of basic main facilities of a sewerage system,
as defined in the Federal Water Pollution Control Act, for
the collection and treatment of sewage and industrial wastes
from lateral or collector sewers. Funds for this part shall
be those which may be available from specifically authorized
sanitary facilities sewerage loans- Such funds shall be
available under the conditions set forth in the legislation

authorizing the funds. FOR PURPOSES OF CLARIFICATION, ANY

REFERENCE IN SUCH LEGISLATION TO MAXIMIZATION OF THE USE OF

FEDERAL FUNDS SHALL BE CONSTRUED TO REFER ONLY TO FUNDS

AVAILABLE UNDER THE FEDERAL WATER POLLUTION CONTROL ACT,

UNLESS EXPRESSLY STATED OTHERWISE. FOR PURPOSES OF

CLARIFICATION, ANY REFERENCE IN SUCH LEGISLATION TO

MAXIMIZATION OF THE USE OF FEDERAL FUNDS SHALL BE CONSTRUED

TO EXCLUDE FEDERAL FUNDS WHICH MAY BE APPLIED TOWARD THE

LOCAL SHARE OF CONSTRUCTION COSTS OR WHICH MAY BE USED TO
SUPPLEMENT ANOTHER FEDERAL GRANT. STATE GRANTS FROM FUNDS
UNDER THIS PART MAY NOT EXCEED THE DIFFERENCE BETWEEN THE
