AN ACT concerning

Fire Resistant Insulating Material

FOR the purpose of requiring that certain insulating
material meet certain minimum standards; providing for
establishment of certain standards; requiring that
certain persons retain certain evidence that insulation
meets established standards; providing procedures for
enforcement; and providing penalties; and providing for
a certain effective date.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article — Commercial Law

13-313.

(A)    A PERSON MAY NOT SELL OR DISTRIBUTE CELLULOSE AND
OR FOAM INSULATING MATERIAL WHICH IS INTENDED ULTIMATELY FOR
THE INSTALLATION IN A PERMANENT OR TEMPORARY HOUSEHOLD OR
RESIDENCE, UNLESS THE INSULATING MATERIAL MEETS MINIMUM
STANDARDS OF FIRE RETARDANCY ESTABLISHED BY THE STATE FIRE
PREVENTION COMMISSION, OR THE FEDERAL GOVERNMENT, OR A

NATIONALLY RECOGNIZED TESTING LABORATORY WHICH TESTS AND

LISTS INSULATING MATERIAL IN ACCORDANCE WITH A NATIONAL

CONSENSUS TESTING STANDARD.

(B)    THE STANDARDS OF FIRE RETARDANCY SHALL BE BASED
ON THE RESULTS OF TESTS CONDUCTED BY A RECOGNIZED FIRE
TESTING LABORATORY APPROVED BY THE STATE FIRE MARSHAL.

(C) A PERSON WHO SELLS OR DISTRIBUTES INSULATING
