Local Washington County - Government Administrative
Procedure Act

FOR the purpose of requiring certain procedures before
certain agencies may adopt rules; requiring certain
agencies to adopt certain rules of procedure; requiring
certain agencies to file copies of rules with certain
authorities; requiring certain agencies to compile
their rules; permitting declaratory judgments on the
validity of rules under certain circumstances;
permitting certain agencies to issue advisory opinions
on rules under certain circumstances; permitting
judicial review of certain rules and proceedings of
certain agencies under certain circumstances; providing
for certain procedures in contested cases before
certain agencies; granting certain agencies certain
status under certain circumstances; providing that this
Act shall supersede certain rule making procedures;
providing that certain rules may not be enforced after
a certain date unless copies are filed with certain
authorities; and generally relating to the rule making
authority and procedures of certain local Washington
County government agencies.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

(A)         IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE

MEANINGS INDICATED.

(E)         "AGENCY" MEANS ANY BOARD, COMMISSION, DEPARTMENT

OR OFFICER OF A WASHINGTON COUNTY OR MUNICIPALITY AUTHORIZED
BY LAW TO MAKE RULES OR ADJUDICATE CONTESTED CASES.
"AGENCY" DOES NOT INCLUDE THE CIRCUIT COURT OF ANY

WASHINGTON COUNTY; THE COUNTY COUNCIL OR COUNTY

COMMISSIONERS OF ANY WASHINGTON COUNTY OR THE CITY COUNCIL,

BY WHATEVER NAME KNOWN, OF ANY MUNICIPALITY        WHEN ACTING

STRICTLY AS A LEGISLATIVE BODY; THE WASHINGTON SUBURBAN
SANITARY COMMISSION; OR THE MARYLAND NATIONAL CAPITAL PARK
