publisher who engages such persons to sell or distribute its
newspapers.

[(7)] (6) Any person who is an
apprentice, trainee, or retrainee, who is regularly
employed, while receiving training or instruction outside of
regular working hours so long as the training or instruction
is related to his employment.

[(8)] (7) Farming and dairy farming,
other than office work, and including, by way of
illustration and not by way of limitation, the operation of
any machinery connected with any phase of soil, crop or
animal management, construction and repairs of machinery and
fixtures, and the handling of any crops or animals with or
without machinery.

For the purposes of this section, a farmer is defined
as one who has three (3) or more full—time employees or who
has a yearly payroll for his full—time employees of at least
fifteen thousand dollars ($15,000) provided, however, that
this section shall not apply to seasonal or migratory farm
laborers who do not operate machinery or equipment.

[(9)] (8) Any person employed as a
domestic servant in a private home who earns $250 or more in
cash in any calendar quarter from any single household.

[(10)] (9) Student teachers and student
interns as provided in Article 77, §112B(b).

Definitions as used in this article:

(4) If an employer is a partnership, or sole
proprietorship, the employer may elect to include as an
"employee" within the provisions of the act, any member of
the partnership, or the owner of the sole proprietorship,
devoting full time to the partnership or proprietorship
business. Any officer of [the] A CLOSE corporation
[rendering services for the corporation for monetary
remuneration] may elect not to exempt themselves from
coverage under the provisions of §21(b)(2). In the event of
such election, the employer must serve upon the employer's
insurance carrier and upon the Commission written notice
naming the persons to be covered and no proprietor or
partner or officer of a CLOSE corporation shall be deemed an
employee within this article until the notice has been
served as aforesaid.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
