1878                                LAWS OF MARYLAND                                     Ch. 600

FINDINGS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978. It shall remain effective

for a period of three years and, at the end of June 30,

1981, and with no further action required by the General

Assembly, this Act shall be abrogated and of no further

force and effect.

AN ACT concerning

Dams - Repair Work

FOR the purpose of authorizing the Department of Natural
Resources to have certain work done on certain
facilities at the expense of the owner under certain
circumstances; providing for repayment of these
expenses; requiring certain duties of the owners of

these facilities; making certain clarifying changes;

providing for a certain exception; and making stylistic
changes.

BY repealing and reenacting, with amendments,

Section 8-809

Annotated Code of Maryland

(1974 Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article — Natural Resources

8-809.

(A) [Upon] ON complaint or its own initiative, the
[department] DEPARTMENT may investigate or examine any
reservoir, dam, or waterway obstruction SIMILAR WATERWAY
CONSTRUCTION. If the [department] DEPARTMENT determines
THAT he reservoir, dam, or waterway obstruction SIMILAR

WATERWAY CONSTRUCTION is unsafe, needs repair, or should be

removed because it is unsafe and not repairable, the
[department] DEPARTMENT shall notify the owner in writing to
repair or remove the object, as the situation warrants. The
repair or removal work shall [commence and proceed to
